Agreement

These terms apply when you use fathomsolutions.ai, submit a form on it, contact our business line, or engage Fathom Business Solutions LLC (Fathom, we, us) for work. If you do not agree with them, please do not use the site or the services.

A signed proposal or statement of work for a specific engagement sits on top of these terms. Where the two disagree, the signed document wins for that engagement.

What Fathom provides

Fathom provides business diagnostic, automation, and consulting services. The specific scope, price, and timeline of any engagement is set out in a written proposal or statement of work, not on this website. Nothing on this site is an offer to perform work at a stated price.

Text messaging program

Fathom operates a low volume, conversational text messaging program on its business line, (818) 392-5499. It is confirm to continue: the first message we send always asks for your consent, and we send nothing further until you give it.

Who receives messages, and how you consent. Only people who have contacted us first, and only after they confirm. If you call the line and we do not answer, you receive one automated text that asks for your consent to continue by text. Nothing further is sent unless you reply YES or another affirmative. If you text the line first, we reply within that same conversation. We do not add anyone to a list, and we do not buy, rent, or import phone numbers from anywhere.

What we send. Replies about your inquiry, scheduling, and questions about our services. We do not send promotional broadcasts.

Frequency. Message frequency varies and depends on your conversation with us. In practice this is a small number of messages, and only while we are actively in contact.

Cost. Message and data rates may apply. Fathom does not charge you for messages, but your mobile carrier may.

How to stop. Reply STOP at any time to end messages. Reply HELP for help. You can also tell us to stop by any other method and we will.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Engagements, quotes, and payment

Quotes are valid for 30 days unless the quote says otherwise. Work begins once the proposal is accepted and any required deposit is received.

Invoices are due on the terms stated on the invoice. Card payments are processed by Stripe, and are subject to Stripe terms in addition to these.

Recurring engagements have the minimum term stated in the signed document for that engagement. Either side can decline to renew at the end of a term.

Your responsibilities

Work of this kind depends on access and on straight answers. You agree to provide accurate information, reasonable access to the systems in scope, and timely responses where an engagement needs a decision from you.

You are responsible for having the right to grant any access you grant us, and for your own legal and regulatory obligations in your industry.

Ownership of the work

On full payment, the deliverables produced specifically for your engagement are yours.

Fathom keeps ownership of its own pre-existing methods, tooling, templates, and general know how, including anything developed before or outside your engagement. Nothing here transfers that.

Confidentiality

Information you share about your business is treated as confidential and is used to do the work, not for anything else. We do not train models on your data and we do not resell your information.

We may describe work in general, anonymized terms unless you tell us not to. We will not name you or reveal identifying detail without your permission.

No guarantee of specific results

Fathom gives an honest professional assessment and builds what the engagement scopes. Business outcomes depend on factors outside our control, including your market, your team, and how the work is adopted after delivery. Nothing on this site or in our materials is a guarantee of a specific financial result.

Nothing here is legal, tax, or accounting advice.

Limitation of liability

To the maximum extent the law allows, Fathom is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data.

Where liability cannot be excluded, total liability for any claim is limited to the fees you paid Fathom for the engagement the claim arises from.

Governing law

These terms are governed by the laws of the State of California. Any dispute will be brought in the state or federal courts located in Los Angeles County, California.

Changes to these terms

We may update these terms, and we change the date at the top when we do. The version in effect when your engagement was signed governs that engagement.
